These Terms and Conditions (“Terms”) govern your use of the Safesense mobile application (“App”), operated by Bluemind Bilisim LTD. Please read these Terms carefully before using the App.
1. Acceptance of Terms
By downloading, accessing, or using Safesense, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the App.
2. License
This App is licensed to you, not sold. Your use of Safesense is also subject to Apple’s Standard End User License Agreement (EULA), available at apple.com/legal/internet-services/itunes/dev/stdeula. In the event of any conflict between these Terms and Apple’s EULA, Apple’s EULA shall govern with respect to usage rights of the App as distributed through the Apple App Store.
3. Description of Service
Safesense provides family safety and health monitoring features, including location sharing, health data insights, alerts and notifications, and Circle-based data sharing. Safesense is not a medical device and does not provide medical advice.
4. Eligibility
You must be at least 18 years of age to create a Safesense account. By creating an account, you represent and warrant that you are 18 or older. Safesense does not knowingly allow anyone under 18 to create an account.
A parent or legal guardian (who is 18 or older and holds a valid Safesense account) may add a minor as a Circle member. The parent or guardian assumes full legal responsibility for the minor’s participation, including obtaining all required consents under applicable law.
5. Circle Permissions and Data Sharing
Safesense is built on a principle of user-controlled, granular data sharing. All users — both Circle owners and Circle members — have full, independent control over what data they share:
- Each user independently decides which data types to share within their Circle (e.g., location, heart rate, sleep, activity) on a per-type basis
- A Circle member may, for example, share their location but choose not to share their heart rate or any other health metric
- No data is shared by default — sharing requires an explicit action by the user
- Permissions can be changed or fully revoked at any time; changes take effect immediately
- Revoking a permission means other Circle members immediately lose access to that data type
- Safesense does not grant Circle owners access to a member’s data without that member’s explicit permission
Users are responsible for reviewing and managing their own sharing settings. Safesense is not liable for data that a user has voluntarily chosen to share with Circle members.
6. User Responsibilities
- Provide accurate and complete account information
- Use the App for lawful purposes only
- Do not use Safesense to monitor, track, or surveil any person without their explicit knowledge and consent
- Do not use the App for stalking, harassment, or any abusive purpose
- Maintain the security of your account credentials
- Comply with all applicable local, national, and international laws
7. Health and Emergency Disclaimer
Safesense is not a medical device. All health data is informational only and may not be accurate, complete, or real-time. Do not rely on Safesense for medical decisions. Always contact local emergency services in an emergency — Safesense does not contact emergency responders on your behalf.
- Not intended to diagnose, treat, cure, or prevent any medical condition
- Not a replacement for professional medical advice, diagnosis, or treatment
- Health metrics may contain inaccuracies due to device or sensor limitations
- GPS location data may be inaccurate or delayed
- Alerts and notifications are not guaranteed to be delivered in real time
- User assumes all risk arising from reliance on app data
8. Subscriptions and Payments
- Safesense offers subscription plans with a 7-day free trial
- The free trial automatically converts to a paid subscription unless canceled at least 24 hours before the trial period ends
- All payments are processed exclusively through the Apple App Store — Safesense does not store any payment or financial information
- Paid subscriptions auto-renew unless canceled at least 24 hours before the end of the current billing period
- To cancel, open your Apple ID account settings and manage your subscriptions there
- Free trial eligibility is determined by Apple and may vary by account
- Refunds are handled solely by Apple per their standard refund policies
- Prices may vary by region and are displayed in the App Store prior to purchase
9. Account Termination and Deletion
You may permanently delete your account and all associated data at any time within the app:
- Delete all data: Profile → Settings → Privacy & Security → Delete Data
- Delete health data only: Profile → Settings → Privacy & Security → Delete Health Data
Upon account deletion, all personal data is permanently removed from our servers within 30 days.
We reserve the right to suspend or terminate accounts that violate these Terms, engage in misuse, or are subject to legal requirements. We will provide reasonable notice where practicable.
10. Data and Privacy
Your use of Safesense is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to data processing as described in the Privacy Policy.
11. Intellectual Property
All content, design, trademarks, logos, and software in Safesense are owned by Bluemind Bilisim LTD or its licensors. You may not copy, distribute, modify, reverse engineer, or create derivative works from any part of the App without our express written permission.
12. Limitation of Liability
To the maximum extent permitted by applicable law, Safesense and Bluemind Bilisim LTD shall not be liable for:
- Inaccurate or delayed health data
- GPS inaccuracies or delayed location updates
- Missed, delayed, or undelivered notifications or alerts
- Loss of data
- Any indirect, incidental, special, consequential, or punitive damages
- Any harm arising from unauthorized use of your account by a third party
- Data voluntarily shared by a user with Circle members
Our total aggregate liability to you for any claim shall not exceed the amount you paid for the App in the 12 months preceding the claim.
13. Service Availability
We do not guarantee uninterrupted, error-free, or real-time operation of the App. Features may be modified, suspended, or discontinued at any time with reasonable notice where practicable.
14. Governing Law and Disputes
These Terms are governed by the laws of the Republic of Turkey. Any disputes arising from these Terms or your use of Safesense shall be subject to the exclusive jurisdiction of the courts of Turkey.
15. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via in-app notification or email. Continued use of the App after receiving notice constitutes your acceptance of the updated Terms.
